Prosecutors and Defenders
The Montgomery County Prosecutor’s Office has one of the greatest impacts on the jail population. Its attorneys determine whether or not to indict someone, and on what charges. In addition, prosecutors have discretion in the amount of bond they request. Higher bond, if set by the judge, means fewer people will be able to afford it and more will be held in jail. Likewise, fewer indictments for low-level offenses would result in a lower jail population.
The Law Office of the Public Defender provides legal representation to citizens accused by the government of criminal conduct that can result in a loss of freedom. They defend cases including Felonies, Misdemeanors, Appeals, and Juveniles. Public Defenders provide these legal services to all persons and base qualification decisions solely on economic status.
